Terms of Service

These Terms of Service (“Terms”) govern your use of the Social Season Club mobile app, our website at socialseasonclub.com, and any related services (together, the “Service”). Social Season Club is operated by Jose Negrete, a sole proprietor based in Dallas, Texas (“SSC,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.

1. Eligibility

You must be at least 17 years old to use Social Season Club. By creating an account you represent that (a) you are 17 or older, (b) the information you provide is accurate, and (c) you have not been previously suspended or removed from the Service. If we learn that you are under 17, we will terminate your account.

2. Your Account

You are responsible for keeping your login credentials safe and for everything that happens under your account. Notify us immediately at fuegaux@gmail.com if you suspect unauthorized access. You may delete your account at any time from Settings → Account → Delete Account, which removes your profile and submitted content as described in our Privacy Policy.

3. Acceptable Use

You agree not to use the Service to:

  • Post events or content that are illegal, fraudulent, harassing, hateful, threatening, sexually explicit, or that promote violence or self-harm.
  • Post events that don’t exist, are misrepresented, or that you don’t have the right to organize at the listed venue.
  • Harvest, scrape, or otherwise collect data about other users without their consent.
  • Impersonate any person, business, venue, or organization.
  • Use the Service to send spam, unsolicited commercial messages, or to drive traffic to unrelated services.
  • Attempt to reverse-engineer, decompile, or otherwise extract source code, except as permitted by applicable law.
  • Interfere with or disrupt the Service or the servers it runs on.
  • Use the Service in violation of any law, regulation, or third-party right.

We may remove content and suspend or terminate accounts that violate these rules, in our reasonable discretion.

4. Hosting Events

When you create an event on Social Season Club, you are the host. That means:

  • You are responsible for what happens at your event, including the venue, the safety of attendees, compliance with local laws and venue rules, and any required permits or insurance.
  • You represent that you have the right to host at the listed location — at your own home, a venue you’ve booked, a public space that permits gatherings, etc.
  • You are responsible for accurately representing the event (time, location, age requirements, cost, capacity, whether alcohol or food is served).
  • You will not host events that involve illegal activity, including underage drinking, controlled substances, or unlicensed services.
  • Social Season Club is a platform that helps you reach people; we are not a co-host, an event planner, an insurer, or a sponsor of your event, and we make no representations about the attendees who RSVP.

5. Attending Events

When you RSVP to an event hosted by someone else, you do so at your own risk. Social Season Club does not vet hosts, attendees, or venues. Use the same judgment you would use accepting any other invitation: confirm the host, read the description, tell a friend where you’ll be, and trust your gut if something feels off.

6. User Content

You retain ownership of the events, photos, descriptions, and other content you submit (“User Content”). By submitting User Content, you grant Social Season Club a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content for the purpose of operating, promoting, and improving the Service. This license ends when you delete the content, except for backup copies retained as described in the Privacy Policy.

You represent that you own or have the necessary rights to the User Content you submit, including any flyer images, photos, and venue images, and that the content does not infringe any third party’s rights.

7. Club Membership (Subscriptions)

The Club is an optional paid subscription that unlocks additional features (currently $12.99 USD per month). Subscriptions are sold through Apple In-App Purchase and managed by RevenueCat. By subscribing:

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Your subscription auto-renews each month unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription in Apple ID → Subscriptions on your device.
  • No refunds or credits for partial subscription periods, except as required by Apple’s refund policy or applicable law.
  • We may change pricing or the features included in Club Membership; if we do, we will give you notice and the option to cancel before changes take effect.

8. Reporting and Moderation

You can report any event or user that appears to violate these Terms. We review reports manually, typically within 24 hours during business days. We may remove content, suspend accounts, or refuse service for any reason consistent with these Terms, applicable law, or our community standards.

9. Intellectual Property

The Service — including the Social Season Club name, the gold-and-onyx visual identity, the app interface, the website, and any software, text, graphics, logos, and other materials we create — is owned by Social Season Club and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes, subject to these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY EVENT LISTED ON SOCIAL SEASON CLUB WILL ACTUALLY OCCUR, BE SAFE, OR MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOCIAL SEASON CLUB AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SOCIAL SEASON CLUB IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Social Season Club and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) events you host or attend through the Service, (c) your User Content, or (d) your violation of these Terms or applicable law.

13. Termination

You can stop using the Service at any time and delete your account from within the App. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The federal and state courts located in Dallas County, Texas will have exclusive jurisdiction over any disputes not subject to the arbitration clause below.

15. Arbitration and Class Action Waiver

Please read this section carefully — it affects your legal rights.

You and Social Season Club agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court, except that (a) either party may bring an individual action in small-claims court, and (b) either party may seek injunctive relief in court for intellectual-property infringement.

The arbitration will take place in Dallas, Texas. The arbitrator’s award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You and Social Season Club waive any right to bring or participate in a class action, class arbitration, or other representative proceeding. All claims must be brought in an individual capacity.

You may opt out of arbitration within 30 days of first accepting these Terms by sending written notice to fuegaux@gmail.com with the subject line “Arbitration Opt-Out.”

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. Material changes will be announced inside the App. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Apple-Specific Terms

If you downloaded the App from Apple’s App Store, you acknowledge that these Terms are between you and Social Season Club, not Apple, and Apple has no responsibility for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. The App must be used in compliance with the Apple Media Services Terms and Conditions.
